Terms of Service
The agreement governing your use of Noteary — accounts, billing, acceptable use, and liability.

These Terms of Service (“Terms”) are a binding agreement between you and Noteary (“Noteary,” “we,” “us,” or “our”) governing your use of our web app, mobile apps, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility & accounts
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. You are responsible for the accuracy of your account information, for safeguarding your credentials, and for all activity under your account. Notify us promptly of any unauthorized use at support@noteary.app.
2. Your content
You own your content. You retain all rights to the audio you record or upload and to the transcripts and summaries generated from it. You grant Noteary a limited, non-exclusive license to host, store, process, transmit, and display your content solely to operate and provide the Service to you. We do not use your content to train AI models and we do not sell it. You are responsible for your content and for having the rights necessary to upload and process it.
3. Lawful recording & consent
The Service records conversations that may include other people. You are solely responsible for obtaining consent from everyone you record and for complying with all applicable recording, wiretap, eavesdropping, and privacy laws. These laws vary by jurisdiction — some require only one party’s consent, while others require the consent of all parties. You agree to record only where you have the legal right to do so, to inform participants where required, and not to use the Service to unlawfully surveil, harass, or harm anyone. See our recording-consent guidance. Noteary is not responsible for your failure to obtain consent or otherwise comply with the law.
4. Acceptable use
You agree not to:
- use the Service to violate any law or the rights of others, including recording someone without required consent;
- upload or process content you have no right to, or that is unlawful, infringing, or harmful;
- attempt to access another user’s data, probe or breach security, or disrupt the Service;
- reverse engineer, resell, or misuse the Service beyond what these Terms permit; or
- exceed or circumvent the usage limits of your plan, or use automated means to abuse the Service.
We may suspend or terminate accounts that violate these Terms.
5. Plans, billing & cancellation
The Service offers a free tier and paid subscription plans with usage limits that are enforced server-side across web, iOS, and Mac. Paid plans are billed in advance on a monthly or annual basis through our third-party payment processor and renew automatically until canceled. You can cancel at any time; cancellation takes effect at the end of the current billing period, and, except where required by law, fees already paid are non-refundable. Prices and plan features may change; we will give notice of material changes as required.
6. AI features & no professional advice
The Service uses third-party AI to transcribe audio and generate summaries, action items, and answers. AI output may be inaccurate, incomplete, or misleading and is provided for convenience only. It is not professional (medical, legal, financial, or other) advice. You are responsible for reviewing and verifying anything important before relying on it.
7. Third-party services
The Service integrates third-party providers for functions such as AI processing, cloud storage, payment processing, email delivery, and optional sign-in. Your use of features that rely on those providers may be subject to their terms. We are not responsible for third-party services we do not control.
8. Export & deletion
You can export your data and delete individual recordings or your entire account at any time from within the app. Deleting a recording removes its audio and searchable memory; deleting your account removes your personal data as described in our Privacy Policy, subject to limited legally required retention.
9. Our intellectual property
The Service, including its software, design, and trademarks, is owned by Noteary and protected by law. These Terms grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. All rights not expressly granted are reserved.
10. Suspension & termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, and limitations of liability) will survive.
11. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. We do not warrant that transcripts or summaries will be accurate or complete.
12. Limitation of liability
To the maximum extent permitted by law, Noteary will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold Noteary harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of others — including any claim that you recorded someone without required consent.
14. Governing law & disputes
These Terms are governed by the laws of the jurisdiction in which Noteary is established, without regard to conflict-of-laws rules, except where mandatory local consumer-protection law provides otherwise. You agree to first contact us at support@noteary.app to seek an informal resolution before initiating a formal dispute.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
